Repair Agreement

Definitions & Terms. References to “us”, “we” and “our” refer to Phone Repair NZ and references to “you” and “your” are references to you, the person addressed on this agreement. References to “device” refer to the iPhone, iPad, Phone, tablet or any other device or devices that are to be or are being repaired. The term “device” may refer to multiple devices if more than one have been brought in for repair. The term “service” and “services” refers to the repair service/s or diagnostic services to be performed.

Minimum Charge. Each device will incur a minimum charge of $35 if it is unfixable or if you decide not to repair. A diagnostic charge of $35 shall apply to devices for assessment, all repairs will be an additional charge.

Pick Up. Please retain your repair ticket for collection of your device. We may at our discretion request photo ID and/or deny pick up from any person other than that named on the repair ticket.

Uncollected Devices. Devices not collected within 20-days from date of invoice or completion will incur an additional $35 charge. Devices not collected within 40-days on invoice or completion will incur an additional $35 charge (Total $70 additional to services or minimum charge). In the event that goods are not collected within 60-days from the date of drop off, we reserve the right to resell, dismantle for parts or dispose of, to recoup any costs and you hand over all rights of ownership to the device to us.

Waiver Of Liability. You agree to release and hold us and our agents free from liability for any claims of damage of any kind or description that may arise from any services and from any loss or damage resulting from any services.

Warranty Policy. Any service is subject to our repair warranty term. We shall not be liable for any damages resulting from defective or faulty parts impacting the usability or function of your device. Water damage is not covered by any warranty and is performed at your own risk. You can request to view this.

Repair Approval. By agreeing to a service, either written or verbal you hereby agree to the outlined work being completed and will be held liable for all costs resulting from such work.

Biometric Sensors & Features. As a result of any service fingerprint readers, face readers  or any other features may not function afterwards. We are not liable for any loss of function resulting from any service and you accept this risk with any service. The device will not be water resistant or proof after any service.

Completion Time. Unforeseen circumstances, courier delays, and work backlogs may have an impact on our ability to complete our services provided to you in the timeframe given. We will not be liable for any damages resulting from a delay in completion time. All timeframes refer to standard business working days and exclude weekends, holidays and other public holidays.

Deposit & Upfront Payment. We reserve the right to request a deposit, up to 100% of the estimated total.

Independent Repairer. We are an independent repairer and in no way associated with any manufacturer. 3rd Party repair may result in voiding the warranty on your device.

Agents. We may subcontract with other service providers and agents for the service of the device.

Service Changes. We may make changes to any product/s or service/s offered, or to the applicable prices for any such product/s or service/s, at any time, without notice. The information provided online with respect to products and services may be out of date, and we make no commitment to update the information provided online with respect to such products and services.

Your Data. During service, the contents of the storage media may be deleted and reformatted. We and our agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the device serviced. You agree that the device can be restored, factory reset or otherwise have the data wiped if required.

Missed Faults. Whilst we do our best to determine in advance what components are faulty from time to time we may miss or not fully find all faults. Therefore any faults determined with the device after the repair has been approved will be subject to a new estimate and will be fully chargeable to you should you accept the estimate.

Manufacturier Changes. Manufacturers may in the future make such changes that impact on the function of 3rd party replacement parts, services or device functions. We are not liable for damages, loss of function or loss of services  resulting from changes by the manufacturer. You may receive notifications of 3rd party parts on the device. TFT screens may consume more additional battery.

Agreement Updates. We reserve the right to change or update this agreement at any time. The most recent version shall be deemed to be in effect.

Logic Board Repair Agreement

1. Definitions And Terms. Reference to “us”, “we” and “our” refer to Phone Repair NZ and references to “you” and “your” are references to you, the person addressed on this agreement. References to “device” refer to the iPhone, iPad, Phone, tablet or any other device or devices that are to be or are being repaired/service performed on. The term “device” may refer to multiple devices if more than one have been brought in for repair.

2. Minimum Charge

  • A minimum charge of $35 applies for all data transfer services. – Applies Regardless of repair outcome
  • Why do we have a minimum charge? This covers the time and expense of assessing and/or attempting repair of your device and allows us to cover our costs (including diagnostic and repair equipment).

3. Waiver Of Liability. You agree to release, indemnify, and hold Phone Repair NZ and it’s agents from liability for any claims or damage of any kind or description that may arise from any repair work performed on your electronic device/s. We are not liable for any removal of parts including IC chips and component parts during the repair and/or diagnostic assessment including if the device is not able to be repaired.

4. Your Data. You should make periodic backup copies of the information contained on the device to protect the contents and as a precaution against possible operational failures. During the diagnostic assessment, repair or data transfer services, the contents of the storage media may be deleted and reformatted. We and our agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the device serviced. You agree that the device can be restored, factory reset or otherwise have the data wiped in the process of repairing or diagnosing the device.

If your device product is capable of storing software programs, data or other information (“data”), we may attempt to transfer said data to a replacement device or drive. During service, it is possible that Data may be lost. In such an event, we will not be responsible for any loss of data.

  • You should maintain a separate backup copy of the contents of the device’s data, remove all personal information that you want to protect and disable all security passwords. During service & data transfer, it is possible that the data will be lost, replaced or reformatted. In such an event we and its agents are not responsible for any loss of software programs, data or other information contained on the device.
  • Data transfer service will involve the transfer of data from the original device to the replacement device or to a compatible external data storage device you provide. We may need to transfer the data to our own or 3rd party owned data storage systems or devices in the process. Any data not collected within 30-Days will be removed and deleted.

5. Warranty Policy. We do not provide a warranty for any data transfer, migration or backup services including any repairs to the device in the process of providing these services.

6. Touch ID & Face ID. As a result of any repair Touch ID and/or Face ID may not function afterwards. We are not liable for any loss of Touch ID and/or Face ID resulting from repair or diagnostic assessment.

7. Change Of Mind. Once the data transfer service has been approved, either verbally or in writing, you agree that the service will go ahead, you cannot change your mind, and you will be liable for any charges relating to the device regardless of whether you no longer want to complete the service.

8. Repair Agreement. This agreement does not override the repair agreement previously agreed to and this agreement shall apply along with the repair agreement which can be viewed here: http://bit.ly/32QpK7x or on request in-store.

9. Loan Phone Agreement. If you accept our offer of a loan phone the use, duration and terms of that offer are subject to our loan phone agreement which can be viewed here: http://bit.ly/30S4DQA or on request in-store.

10. Completion Time. We may provide you with an estimated completion date. If none is provided you may contact us for one. Unforeseen circumstances, courier delays, and work backlogs may have an impact on our ability to complete our services provided to you. We will not be liable for any damages resulting from a delay in completion time. Most repairs take 3-7 days although some repairs may take up to 20 working days if it needs to be sent away for more complicated repair work, these are for estimation purposes only. All timeframes refer to standard business working days and exclude weekends, holidays and other public holidays.

11. Deposit & Upfront Payment. We reserve the right to request a deposit, up to 100% of the estimated total including full upfront payment before any work is completed. If we request a deposit or upfront payment we may notify you prior or after agreeing to data transfer services

12. Repair Approval. By agreeing to  data transfer services, both written or verbal you hereby agree to the outlined work being completed and will be held liable for all costs resulting from such work. You agree to our repair agreement (section 8) and repair warranty (section 5).

13. Important Notes

  • In the event that goods are not collected within 30-days from the date of drop off, we reserve the right to resell, dismantle for parts or dispose of, to recoup any costs.
  • We are an independent repairer and in no way associated with Apple Inc or any other manufacturer. 3rd Party repair may result in voiding the warranty on your electronic device.
  • We are not responsible for any data or information loss as a result of your repair. We strongly advise you to backup your electronic device beforehand.
  • We may subcontract with other service providers for the service of your product.
  • We may make changes to any products or services offered online, or to the applicable prices for any such products or services, at any time, without notice. The information provided online with respect to products and services may be out of date, and we make no commitment to update the information provided online with respect to such products and services.

14. Device Owner. You acknowledge that you are the owner of the device or have been authorised to act & make decisions regarding the device on behalf of the device owner.

15. Data Limitations. Due to limitation in the operating system and security settings we are unable to export, transfer or backup the following data:

  • Touch ID, Face ID, Passcodes or passwords
  • Content synced from iTunes.
  • Data stored in other cloud services.
  • Data within downloaded apps.
  • Apple Pay settings.
  • Apple Watch connections

16. Agreement Updates. We reserve the right to change this agreement at any time.

17. Governing Law. This agreement is governed by the laws of New Zealand.

18. Agreement. This agreement does not need to be signed to apply. We may however at our discretion request you to sign this agreement. Reading, agreeing to data transfer services (even without reading the agreement) or otherwise accepting repair of your device shall execute this agreement into effect.

Loan Phone Agreement

Phone Repair NZ is pleased to extend the offer of a loaner Phone to you while service is performed on your current phone (“Customer Phone”).  By taking possession of the equipment identified in section 1 (“Loaner Phone”) and signing this agreement, you agree to all the terms and conditions listed below:

 

1.  Loaner Phone. You acknowledge receipt of the Loaner Phone listed below which at Phone Repair NZ’’s discretion may be new or refurbished, and agree to return it to Phone Repair NZ (i) no more than fourteen (14) days from the date Phone Repair NZ notifies you that your repaired Customer Phone is ready for pickup or (ii) upon Phone Repair NZ written request to do so (each, a “Return Date”):

 

From the date on which you receive the Loaner Phone through the Return Date, title to the Loaner Phone shall at all times remain vested in Phone Repair NZ.

 

2. Receipt of Customer iPhone when Loaner iPhone Returned. The Loaner Phone is offered to you while your Customer Phone listed on the in-take form is serviced by Phone Repair NZ. Phone Repair NZ will return the Customer Phone to you after service has been completed, the Loaner Device has been returned and all outstanding payments are settled.

 

3. Extended Return Date.  If you have a circumstance that prevents you from picking up your repaired Customer Phone on or before the Return Date, you may submit a request to Phone Repair NZ for an extension of five (5) days beyond the standard fourteen (14) day return period.  You may submit a request for the extension by contacting Phone Repair NZ at the location where the Loaner Phone was provided.  Upon approval of the five (5) day extension, the extended date will become your Return Date for purposes of these terms, and you will be required to return the Loaner Phone by that extended Return Date. All of the terms set forth in this agreement will apply to that extended Return Date.

 

4. Safeguarding.  You must take reasonable and prudent precautions to protect the Loaner Phone against damage, loss, or abuse while in your care, custody, and control.  If the Loaner Phone is lost, stolen or damaged, you must notify Phone Repair NZ immediately.  Only Phone Repair NZ may service the Loaner Phone.  You may be held responsible for repair or replacement costs if the Loaner Phone is lost, damaged, or stolen while on loan.

 

5. Permitted Use.  The Loaner Phone is to be used solely by you while your phone is being serviced by Phone Repair NZ (“Service Period”).  You must not use the Loaner Phone for any unlawful purpose.  Only software with valid licenses should be loaded on the Loaner Phone.

 

6. Delete Your Files Upon Return of Loaner Phone. You acknowledge that before returning the Loaner Phone, you are responsible for erasing all files, including personal and/or confidential files and data, created by you.  Therefore, should you wish to retain any files you created, you should backup your files using iTunes so that the files can later be transferred to your repaired Customer Phone. You are responsible for removing and storing any such files prior to returning the Loaner Phone.  Phone Repair NZ is not responsible nor liable for any files or data remaining on, or erased from the Loaner Phone, following its return.

 

8. Phone Repair NZ Liability.  To the fullest extent permitted by law, Phone Repair NZ will not be liable for any consequential, incidental, indirect or direct damages arising out of these terms or the use of the Loaner Phone, including without limitation any loss of or affecting your personal property, software or data.  

 

9. Governing Law. This Agreement is governed by the laws of New Zealand.

Data Transfer Services Agreement

1. Definitions. Reference to “us”, “we” and “our” refer to Phone Repair NZ and references to “you” and “your” are references to you, the person addressed on this agreement. References to “device” refer to the iPhone, iPad, Phone, tablet or any other device that is the subject of this estimate.

2. This Is An Estimate. This is an estimate and is not a quote. We do not provide a quote due to the nature of our services. Any offer, suggestion or indication of pricing or repair requirements both written or verbal, including those on our website are purely an estimate. This is not a fixed price and may change. For all legal purposes and definitions, this is an estimate.

6. Typographical Errors. In the event that we mistakenly listed a product or service at an incorrect price, we reserve the right to refuse or cancel any orders placed for product listed at the incorrect price. We reserve the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall issue a credit to your credit card account in the amount of the incorrect price.

8. Expiry. If this estimate is not accepted within 14 days of its creation, it will automatically be marked as declined. After 14 days if it has not been accepted it will expire and a new estimate may be required, it will be at our discretion as to if we continue with the existing estimate or require a new estimate which may require another diagnostic assessment at an additional charge.

9. Completion Time. We may provide you with an estimated completion date, normally when parts need to be ordered in. If none is provided you may contact us for one. Unforeseen circumstances and courier delays may have an impact on our ability to complete our services provided to you. We will not be liable for any damages resulting from a delay of completion time. Most repairs take 1-2 days, board level repairs 5 – 14 days and special orders 3 – 14 days, these are for estimation purposes only.

Repair Warranty

1. Definitions. Reference to “us”, “we” and “our” refer to Phone Repair NZ and references to “you” and “your” are references to you, the person addressed on this agreement. References to “device” refer to the iPhone, iPad, Phone, tablet or any other device purchased from Phone Repair NZ subject to these warranty terms. The term “device” may refer to multiple devices if more than one have been brought in for repair. References to “repair”,  “product”  and “service” refer to the repair service that was performed and the component that was replaced. Eg. The screen in a screen replacement service or the battery in a battery replacement service.

 

2.  This warranty is valid only for the first consumer purchaser.

3. Warranty Period. The warranty shall last for a period of:

Screen Repair

182-days (generally referred to as 6-months)

Battery Repair

90-days  (generally referred to as 3-months)

All Other Repairs/Replacements

90-days  (generally referred to as 3-months)

Beginning at the date of repair or invoice date, whichever is earliest. Exchanges, repairs or replacements shall not extend the warranty period, restart the warranty period or roll-over the warranty period. The repair or replacement  unit will be covered by the balance of time remaining on your original limited warranty.

4. We may offer to repair the defect/s, replace it with another or offer a full refund of the purchase price less any postage costs. It shall be at our discretion to decide which option to offer you. Replacement products or parts may include remanufactured or refurbished parts or components.

5. We warrant the device to be free from defects in material during the warranty period.

6. The warranty will only cover manufacturer faults (See section 5) and does not cover the following:

  • Any product on which the serial number and/ or the IMEI has been defaced, modified or removed.
  • Accident, misuse, neglect, fire, water, lightning, or other acts of nature, unauthorized product modification, or failure to follow instructions supplied with the product.
  • Repair or attempted repair by anyone not authorized by Phone Repair NZ.
  • Unauthorised jailbreaking and unlocking of the device resulting in damage to the device.
  • Damage to or loss of any programs, data or removable storage media.
  • Software or data loss occurring during repair or replacement
  • Any damage to the product due to shipment.
  • Causes external to the product, such as electric power fluctuations or failure, including but not limited to charging IC “Tristar” damage.
  • Normal wear and tear (e.g scratches to touchscreen, battery ageing)
  • Damage caused by static (non-moving) images displayed for lengthy periods of time (also referred to as image burn-in).
  • Software – Any third-party software included with the product or installed by the customer.
  • Hardware/Accessories/Parts/Components – Installation of any unauthorized hardware, accessories, consumable parts or components (e.g. Batteries).
  • Damage to, or abuse of, the coating on the surface of the display through inappropriate cleaning.
  • Change of mind.
  • Removal, installation, and set-up service charges.
  • LCD or glass damage due to physical damage. Including LCD only damage.
  • The Product sold and labelled as “AS IS”, “WITH ALL FAULTS” or similar disclaimer, including replacement of missing parts or accessories from those sales, or purchased through an unauthorized online seller.
  •  Any other cause which does not relate to a product defect.

 

7. Proof of Purchase. You must retain a copy of the ticket receipt,  invoice or receipt as proof of purchase. We retain the right to reject any warranty claims where you are unable to produce proof of purchase.

8. Passcode & Apple ID/iCloud. We reserve the right to refuse service or warranty on the device if you are unable to provide the passcode.

9. Your Data. You should make periodic backup copies of the information contained on the device to protect the contents and as a precaution against possible operational failures. During warranty service, the contents of the storage media may be deleted and reformatted. We and our agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the device serviced. We are not responsible for loss of data on the device under any circumstances. You are encouraged to back up all data stored on the device.

10. Before receiving warranty service, we or our agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow our procedures for obtaining warranty service. Before submitting your device for warranty service you should maintain a separate backup copy of the contents of its storage media, remove all personal information that you want to protect and disable all security passwords.

11. Do not attempt to open the device. Opening the device may cause damage that is not covered by this warranty. Only we should perform service on this device.

12. We reserve the right to change the method by which we may provide warranty service to you, and your device’s eligibility to receive a particular method of service.

13. Our liability is limited to the cost of repair or replacement of the product.

14. We shall not be liable for:

  • Damage to other property caused by any defect in the product,
  • Damages based upon inconvenience, loss of use of the product, loss of time, loss of profits, loss of business opportunity, loss of goodwill, interference with business relationships, or other commercial loss, even if advised of the possibility of such damages.
  • Any other damages, whether incidental, consequential or otherwise.
  • Any claim against the customer by any other party.

15. Liquid Damage Any device that has liquid damage present prior to repair shall be void of any warranty and is completed at your own risk. We may determine this through signs of visible liquid present, residue of liquid or activation (including salt or rust buildup) or the liquid contact indicators in the device.

16. Software Services. No warranty including this one shall apply to any software related services such as device restore, factory restore, data export or data transfer. This is extended include support and advice including education and training services which shall be exempt from this and any other warranty.

17. Transit Damage. You are responsible to inspect all goods received from us upon arrival. In instances where goods have been damaged in transit, you must report this to us within 3 days of receipt of the device. Failure to report physical damage on arrival within 3 days of receipt may result in denial of warranty.

18. In the event that a replacement, refund, or credit is provided, the faulty item will become the property of Phone Repair NZ.

19. We may seek reimbursement of any costs incurred where upon arrival and checking, the device is found to be in good working order and/or faults are completely unrelated to services performed by us, thereby negating a claim under warranty.

20. We reserve reasonable discretion to determine whether any device, product or service is or is not performing in accordance with specifications.

21. We aggregate liability in respect of all claims under the warranty shall not exceed the original purchase price of the product or service to the device or, at our option, the replacement of the product with a like or similar product.

22. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

23. Phone Repair NZ or its successor in title is the warrantor under this Warranty.

24. Governing Law. This Agreement is governed by the laws of New Zealand.

Repair Warranty

1. Definitions. Reference to “us”, “we” and “our” refer to Phone Repair NZ and references to “you” and “your” are references to you, the person addressed on this agreement. References to “device” refer to the iPhone, iPad, Phone, tablet or any other device purchased from Phone Repair NZ subject to these warranty terms.

 

2.  This warranty is valid only for the first consumer purchaser.

3. Warranty Period. The warranty shall last for a period of 30-days. Beginning at the date of purchase or invoice date, whichever is earliest. Exchanges, repairs or replacements shall not extend the warranty period, restart the warranty period or roll-over the warranty period. The replacement unit will be covered by the balance of time remaining on your original limited warranty.

4. We may offer to repair the device’s defect/s, replace it with another device of the same model and capacity or offer a full refund of the purchase price less any postage costs. It shall be at our discretion to decide which option to offer you. Replacement Products or parts may include remanufactured or refurbished parts or components.

5. We warrant the device to be free from defects in material and workmanship during the warranty period.

6. The warranty will only cover manufacturer faults (See section 5) and does not cover the following:

  • Any product on which the serial number and/ or the IMEI has been defaced, modified or removed.
  • Accident, misuse, neglect, fire, water, lightning, or other acts of nature, unauthorized product modification, or failure to follow instructions supplied with the product.
  • Repair or attempted repair by anyone not authorized by Phone Repair NZ.
  • Unauthorised jailbreaking and unlocking of the device resulting in damage to the device.
  • Damage to or loss of any programs, data or removable storage media.
  • Software or data loss occurring during repair or replacement
  • Any damage to the product due to shipment.
  • Causes external to the product, such as electric power fluctuations or failure, including but not limited to charging IC “Tristar” damage.
  • Normal wear and tear (e.g scratches to touchscreen, battery ageing)
  • Damage caused by static (non-moving) images displayed for lengthy periods of time (also referred to as image burn-in).
  • Software – Any third-party software included with the product or installed by the customer.
  • Hardware/Accessories/Parts/Components – Installation of any unauthorized hardware, accessories, consumable parts or components (e.g. Batteries).
  • Damage to, or abuse of, the coating on the surface of the display through inappropriate cleaning.
  • Change of mind.
  • Removal, installation, and set-up service charges.
  • The Product sold and labelled as “AS IS”, “WITH ALL FAULTS” or similar disclaimer, including replacement of missing parts or accessories from those sales, or purchased through an unauthorized online seller.
  •  Any other cause which does not relate to a product defect.

 

7. Proof of Purchase. You must retain a copy of the invoice or receipt as proof of purchase. We retain the right to reject any warranty claims where you are unable to produce proof of purchase.

8. Passcode & Apple ID/iCloud. We reserve the right to refuse service or warranty on the device if you are unable to provide the passcode and/ or remove any Apple ID or iCloud account associated with the device.

9. Your Data. You should make periodic backup copies of the information contained on the device to protect the contents and as a precaution against possible operational failures. During warranty service, the contents of the storage media may be deleted and reformatted. We and our agents are not responsible for any loss of software programs, data or other information contained on the storage media or any other part of the device serviced.

10. Before receiving warranty service, we or our agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow our procedures for obtaining warranty service. Before submitting your device for warranty service you should maintain a separate backup copy of the contents of its storage media, remove all personal information that you want to protect and disable all security passwords.

11. Do not attempt to open the device. Opening the device may cause damage that is not covered by this warranty. Only we should perform service on this device.

12. We reserve the right to change the method by which we may provide warranty service to you, and your device’s eligibility to receive a particular method of service.

13. Our liability is limited to the cost of repair or replacement of the product.

14. We shall not be liable for:

  • Damage to other property caused by any defect in the product,
  • Damages based upon inconvenience, loss of use of the product, loss of time, loss of profits, loss of business opportunity, loss of goodwill, interference with business relationships, or other commercial loss, even if advised of the possibility of such damages.
  • Any other damages, whether incidental, consequential or otherwise.
  • Any claim against the customer by any other party.

53. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

16. Phone Repair NZ or its successor in title is the warrantor under this Warranty.

17. Governing Law. This Agreement is governed by the laws of New Zealand.

Redeeming Your Gift Voucher


Bring the voucher in-store. Advise the staff member you wish to pay via gift voucher.

They will check the balance remaining on the voucher and advise if any difference would need to be paid. If the repair/purchase is more than the balance available on the gift voucher you can pay for this difference via cash or EFTPOS.
